Terms & Condition

1. Introduction

These Terms and Conditions govern your use of the AI Calling Agent service provided by 360 Digital Experts (“we”, “our”, “us”). By purchasing or using our service, you agree to these terms in full.

2. Service Agreement

By signing up for any package, you agree that:

  • You have read and understood these Terms & Conditions.
  • You are authorised to enter into this agreement on behalf of your business.
  • You will use our service only for lawful business purposes.
  • You are based in Australia or operating an Australian business.

 

3. Payment Terms

3.1 Advance Payment

All packages are billed in advance. Payment is required before your AI calling agent is activated. We do not provide access to the service until full payment is received.

3.2 Payment Methods

We accept all major credit cards, debit cards, and bank transfers. All prices are in Australian Dollars (AUD) and exclude GST. GST will be added where applicable at checkout.

3.3 Monthly Billing

Your subscription is billed monthly in advance on the same date each month. It is your responsibility to ensure payment details are kept up to date.

 

4. Cancellation Policy

4.1 Cancellation at Any Time

You may cancel your subscription at any time by contacting us at sales@360digitalexperts.agency.

4.2 No Refunds

All payments are non-refundable. If you cancel your subscription: 

  • Your service will remain active until the end of your current paid billing period.
  • No refund will be issued for any unused portion of your subscription.
  • No partial refunds will be provided under any circumstances.

4.3 Service Continuation After Cancellation

Upon cancellation, your AI calling agent will continue to operate until the end of your current billing month. After that date, the service will be deactivated automatically.

4.4 No Auto-Renewal

Your subscription will not automatically renew after cancellation. You will not be charged again after your cancellation is confirmed and your current billing period ends.

 

5. Refund Policy

We operate a strict no-refund policy. This includes but is not limited to:

  • Change of mind after purchase.
  • Dissatisfaction with AI voice quality.
  • Technical issues outside our control.
  • Business closure or restructure.
  • Underutilisation of included minutes or features.

Exception: If we are unable to activate your service within 48 hours of payment due to an error on our part, a full refund will be issued.

 

6. Free Demo

6.1 Demo Terms

Our free demo is provided as a one-on-one live meeting. During this session, our team will walk you through a live demonstration of the AI calling agent tailored to your business. The demo is for evaluation purposes only and does not constitute a paid subscription.

6.2 Demo Booking

The free demo is available by appointment only. You can book your demo session through our website. Demo sessions are subject to availability.

6.3 Demo Limitations

The demo is a one-time session per business. We reserve the right to decline or reschedule demo requests at our discretion.

 

7. Setup Fees

7.1 One-Time Fee

A one-time setup fee is charged at the commencement of your service. This fee is non-refundable regardless of cancellation. Setup fees exclude GST.

7.2 Setup Timeframe

We aim to have your AI calling agent live within 24 hours of payment and setup completion. Delays caused by incomplete information provided by the client are not our responsibility.

 

8. Usage Limits & Overages

8.1 Included Usage

Each package includes a set number of voice minutes, SMS, and emails per month as stated on our pricing page.

8.2 Overage Charges

If you exceed your included usage limits, overage charges will apply. You will be notified before additional charges are applied where possible. All overage charges exclude GST.

8.3 Unused Usage

Unused voice minutes, SMS, or emails do not roll over to the next month. They expire at the end of each billing period.

 

9. Service Availability

We aim to provide a reliable and uninterrupted service. However, we do not guarantee 100% uptime and are not liable for:

  • Scheduled maintenance periods.
  • Third-party platform outages.
  • Internet or telecommunications disruptions.
  • Events outside our reasonable control (force majeure).

 

10. Client Responsibilities

You are responsible for:

  • Providing accurate business information during onboarding.
  • Ensuring your calendar and booking systems are correctly connected.
  • Complying with Australian telecommunications laws regarding call recording disclosure.
  • Not using our service for any unlawful, fraudulent, or harmful purpose

 

11. Intellectual Property

All AI scripts, workflows, automation sequences, and systems developed by 360 Digital Experts remain our intellectual property. You are granted a limited, non-exclusive licence to use these during your active subscription period only.

 

12. Limitation of Liability

To the maximum extent permitted by Australian law, 360 Digital Experts is not liable for:

  • Loss of revenue or business opportunities.
  • Indirect or consequential losses.
  • Damages arising from reliance on AI-generated call responses.
  • Any loss caused by third-party platform failures

Our total liability to you shall not exceed the amount paid by you in the most recent billing month.

 

13. Privacy

Your use of our service is also governed by our Privacy Policy, which forms part of these Terms & Conditions. By using our service, you consent to the collection and use of your information as described in our Privacy Policy.

 

14. Governing Law

These Terms & Conditions are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the Australian courts.

 

15. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. We will notify you of significant changes via email. Continued use of our service after changes constitutes your acceptance of the updated terms.
